My boyfriend's co-worker was fired. When he asked his boss, his boss said because he was looking for another job. Is this wrong? If you know these laws, please answer ...
Is it legal for your employer to fire you because "you are looking for another job"?
Some states are no-fault states. You can be fired for no reason.
It also depends on what you're doing. I make financial decisions and exceptions daily. If my boss knew I was looking for another job, he may be concerned with the quality of my work or the ethics in my decisions. He may let me go to keep me from making decisions that may not be in the best interest of the company.
Reply:They don't need a reason no matter what anyone tells you.
Reply:Talk to a someone associate with the Department of Labor. There are labor laws against getting fired by your employer. NOW, the employer do have the right to fire a person with out giving an reason why but, there are law in Georgia that allow you the right to fight and sue an employer for unreasonable doubt.
Reply:If he was using company resources (using the fax, phone computer) and time when he should of been working for his current employer, then yes he was in the wrong.
Reply:No, it is wrong. He could have a claim for unfair dismissal if he's worked there for more than a couple of years.
Like someone else replied, it would be unwise to use company time or resources to look for alternative employment.
The best policy when looking for another job, however, would be to keep it to yourself, until you've signed a contract and handed in your notice.
Reply:If it is a right to hire right to fire state they can. But, other than that they have to give a suitable reason. Have him call an attorney for a free consultation.
Reply:No they cannot do that unless you are doing this on ur employers expense...noone can fire anyone just b/c someone is looking for another job...its not legal..
Reply:It is legal. Most of us are 'at will' employees, meaning we can quit at any time, and we can be fired at any time. Certainly, you can't be fired for being a minority or a protected disability, but for the most part, most of us are at will, and hence have no job security as such.
Scary thought, huh?
Reply:If you live in a state that allows for "at will" employment (such as California and most states), then this is perfectly legal. An employer can fire you without cause, and you can quit your job without cause. Essentially, your employment is based on mutual agreement between you and your employer.
However, being fired due to discrimination (racial, ethnic, age, sexual orientation, religion) is illegal.
If you signed an employment contract with your employer, then you need to check the terms of the contract.
Reply:No ,as long as you do it on your own time and not from thier office or place of work..
Reply:i was told, by a lawyer, one time that your employer could can you for anything as long as you are not under contract...now if he was under contract he can call a lawyer for wrongful termination....
Reply:I don't believe it is legal. He should have been more discreet about leaving though because, legal or not, it does happen.
